Briefing schedule is in

Judge O'Connell sent out the schedule for submitting the briefs that will be the final part of the hearing record.

Closing briefs will be due Friday, Sept. 23.

The APA staff mailed the final disk for the hearing transcript earlier today, and O'Connell is assuming the final set of transcript CDs within five days. So that leaves about 43 days, according to my calculations (though I'm terrible at math, so correct me if I'm wrong), for parties to prepare their closing briefs.

Then they have about another 30 days before they have to submit their replies to other closing briefs. They are due by 5 p.m. Monday, Oct. 24.

This is kind of right in the middle of all the parties' requests. Most of the supporters were asking for 30 days and 30 days, while most of the other people were looking for 60/30 or around there.

This schedule would mean the set of three meetings, each a month apart, that the APA is planning to familiarize commissioners with the record would begin in November, then run through December and January, with a decision due at the January meeting. Three months is longer than the typical time clock for APA decisions, but developers had agreed to let it be extended as long as they could get a decision by the end of January.
